TheinfluenceofNormanlawyerswasexercisedinshapingoutcertainactionablerights,theeffectofconquestwastonarrowtoaparticularclassaprotectionoriginallyconferredbroadly,andtheactionofSaxontraditionwastosupplyageneralstockoffreedomandindependentright,fromwhichtheprivilegedconditionofNormantimescoulddrawitsnourishment,ifImayputitinthatway。ItwouldbeidlenowtodiscussinwhatproportiontheSaxoninfluenceonthesideoffreedomhastobeexplainedbytheinfluxofmenwhohadbeenoriginallyownersoftheirlands,andwhatmaybeassignedtothecontractualcharacterofSaxontenant-right。ThissubjectmustbelefttillwecometoexaminetheevidencesuppliedbySaxonsourcesofinformation。MypresentpointisthattheancientdemesnetenureoftheConquestisaremnantoftheconditionofthingsbeforetheConquest。(108*)

ItmaywellbeaskedwhythedestructiveeffectsofNormanvictorywerearrestedonancientdemesnesoil?Wasnotthekingaslikelytoexercisehisdiscretioninrespectofthepeasantryasanyfeudallord,andisitlikelythathewouldhavelethimselfbefetteredbyconsiderationsandobligationswhichdidnotbindhissubjects?Inviewofsuchquestionsoneistemptedtotreattheprotectionofthetenantsontheancientdemesnemerelyasapeculiarboongrantedtothepeoplewhomthekinghadtogiveaway。Ineednotsaythatsuchaninterpretationwouldbeentirelywrong。IhopeIhavebeenabletomakeoutconvincinglythatlegalprotectiongivenagainstprivatelordsonmanorswhichhadbeenalienatedwasonlyanoutgrowthfromthatcertaintyofconditionwhichwasallowedontheking’sownlands。Iwilljustaddnowthatoneverystrikingfactoughttobenoticedinthisconnexion;certaintyoftenureandserviceislimitedtooneparticularclassinthemanor,althoughthatclassisthemostnumerousone。Ifthisprivilegecameintobeingmerelybythefixationofstatusatthetimewhenamanorpassedfromthecrown,thestateofthevillainpurewouldhavegotfixedinthesamewayasthatofthevillainsocman。Butitdidnot,andsoonecannotshirkthedifficultquestion,Whatgaverisetothepeculiarprotectionagainstthelordwhenthelordhappenedtobeking?
